 Introduction In the Australian Justice setup, children starting from 10 years are responsible for their crimes. However, it has been challenging to measure the extent or nature of a crime committed by juveniles. Reports in the late 1900s show that most students in secondary schools in NSW have committed crimes. The crimes by juveniles were to be shared but temporary. Juvenile crimes are not violent; hence they are referred to as 'not serious.' These crimes involve drug-related crimes like the use of cannabis, directed at people's property, which is very temporary, and, most of the time, is not organized. In other cases, developing children are prone to impulsive behavior; hence, they are unaware of the rimes they omit (Crofts, T., 2019. pp.26-40). Calls made require the jurisdictions of Australia to lower the minimum age for criminal responsibility from ten years. At 18 years, juveniles are termed adults and hence convicted for crimes as adults in NSW. However, it varies between 17 and 18 years, depending on the jurisdiction. According to the Doli IncapaxPrinciple, a child below 14 years is incapable of committing crimes because they are unaware that what they are doing is wrong. In Latin, Doli Incapax means being incapable of committing a crime. To prosecute a child will require the jury to provide reasonable proof that the child knew what they did was wrong when they committed the crime O'Brien and Fitz-Gibbon (2017, p.139). Presuming that the child knew that their actions were an offense is unnecessary because it will sabotage their safety, especially when criminal law application is by full force. There have been proposals to abolish the Doli Incapax principle. To satisfy the rights protecting juveniles and international obligations, Australia should increase the minimum age where youngsters become responsible for their criminal acts. Australia must retain the principle of Doli Incapax from criminal matters that involve children aged below 14 years.
